Power of Attorney Solicitors in Northern Ireland

A power of attorney is a legal document that allows you to appoint a trusted person to make decisions on your behalf if you become unable to do so yourself. At J.J. Taylor & Co Solicitors in Armagh, we guide clients across Northern Ireland through the process of granting and registering powers of attorney.

What Is a Power of Attorney?

In Northern Ireland, the relevant document is an Enduring Power of Attorney (EPA), which is governed by the Enduring Powers of Attorney (Northern Ireland) Order 1987. An EPA allows you to appoint one or more attorneys to manage your property and financial affairs if you lose mental capacity. Northern Ireland has not yet introduced the Lasting Power of Attorney (LPA) system used in England and Wales, so it is important to take advice from a solicitor familiar with Northern Ireland law.

Why Grant a Power of Attorney?

  • Ensures your finances and property can be managed if you lose capacity
  • Avoids the need for a costly and time-consuming court application
  • Gives you peace of mind that a trusted person is in control
  • Can be set up while you are still fully capable — it does not take effect until needed

Our Power of Attorney Services

  • Drafting and executing enduring powers of attorney
  • Advising on the choice of attorney and the scope of their powers
  • Registering an EPA with the Office of Care and Protection when required
  • Advising attorneys on their duties and responsibilities

Why Act Now?

A power of attorney can only be granted while you have mental capacity. If you wait until a health crisis occurs, it may be too late to put one in place, and your family may need to apply to the court for a Controllership Order — a much more expensive and lengthy process. We strongly recommend putting an EPA in place as part of your wider estate planning.
